Vide Office Order No.217/2008 dated 10.09.2008, sanction of the President was conveyed for ad-hoc promotion of 160 officers from the grade of Superintendent of Central Excise and Superintendent of Customs (Preventive) to the grade of Assistant Commissioners. The promotions were on in-situ basis and it was communicated that formal posting/ transfer orders will be issued separately. Thereafter, vide Office Order No.300/2008 dated 26.12.2008, additional 5 officers were similarly given ad-hoc promotion on in-situ basis. The postings to these 165 officers could not be given earlier in view of the directions of Hon’ble CAT, Bombay Bench, vide their Order dated 11.09.2008 in OA No.360/2008 filed by Shri M. N. Dhar. The directions have now been modified by the Hon’ble CAT, Bombay Bench vide their Order dated 13.01.2009 in MP No.678/ 2008 filed by the Department in OA No.360/2008. The question of postings of already promoted officers has been delinked from the promotion of officers from the grade of Customs Appraisers. The Hon’ble CAT, Bombay Bench has directed that the postings to the officers already promoted to the grade of Assistant Commissioners are to be given within one month.
2. Out of total 165 officers so promoted, 4 officers are no longer required to be given postings due to retirement, etc. Therefore, 161 officers are required to be given postings. As per Para-4.4 of the Transfer Policy for Group-A Officers, the officers promoted from Group-B to Group-A, on promotion, are required to be transferred out of the station in which they were previously working, unless the balance service is less than 3 years.
3. In view of the above, with the approval of the competent authority, the following transfers/ postings in the grade of Assistant Commissioner of Customs and Central Excise are hereby ordered with immediate effect and until further orders:-

4. All Chief Commissioners/ Directors General concerned are requested to ensure that the officers who are left with more than three years of service are shifted from their present station and are posted to another station in the Zone, in terms of Para-4.4 of the Transfer Policy referred to in Para-2 above, in case the Zone allotted to them is the same as their present Zone.
5. All the officers mentioned above may be relieved immediately and they should join at their new place of posting on or before 16.02.2009, under intimation to the Board. The Chief Commissioners/ Directors General may send compliance reports regarding relieving and joining of the officers to the Board by 25.02.2009.
